In accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), we hereby inform you of the rules governing the processing of your personal data collected when using the Controller’s websites.

We make every effort to provide the stored personal data with all possible adequate measures of physical, technical and organisational protection against its accidental or intentional destruction, accidental loss, alteration, unauthorised disclosure, use or access, in accordance with all relevant provisions of law.

I. Definitions

Controller – BRINK BEV Spółka Akcyjna with its registered office in Warsaw at ul. Zajęcza 2b, 00-351 Warsaw, registered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under the KRS number 0001098781, holding Tax Identification Number (NIP) 5252995930, Business Registry Number (REGON) 527953195, and Waste Database (BDO) number 000640481, share capital of PLN 100,000.00 (in words: one hundred thousand Polish zlotys), fully paid up, having the status of a large enterprise within the meaning of the Act of 8 March 2013 (as amended) on counteracting excessive delays in commercial transactions.

Cookies – means computer data, in particular small text files, saved and stored on devices, through which the User uses the Service’s websites.

User – means an entity to which, in accordance with the Policy and applicable law, services may be provided electronically or with which an Agreement for the provision of electronic services may be signed.

Device – means an electronic device through which the User gains access to the Service.

II. Personal data collected on the website
  1. When you use this website, we may process your personal data, such as your Device’s IP address
  2. Personal data is processed by the Controller’s employees and associates on the basis of the authorisations granted to them. Every person authorised to process personal data has been made aware of the data protection rules and has undertaken to keep the information provided confidential.
  3. Personal data may be entrusted to an external entity that assists the Controller in achieving the purposes of processing, including marketing, hosting, IT, administrative, legal and advisory services.
  4. The Controller uses the services of specialist providers who ensure that services are performed and that the information entrusted to them is kept secure to an appropriate standard, in accordance with applicable law.
III. Purpose of personal data processing

Personal data is processed for the purpose of presenting the Controller’s offer or information about the Controller. The legal basis for the Controller’s processing of personal data is Article 6(1)(f) of GDPR, i.e. the Controller’s legitimate interests.

IV. Rules and timeframes for the processing of personal data
  1. Your personal data was collected directly from you when you decided to visit our website, leaving your device’s IP address, or when you sent us an enquiry to the email address provided on our website.
  2. The User has the right to:
    • Request from the Controller access to data and to receive a copy of it (Article 15 of GDPR).
    • Request that the Controller rectify or correct your data (Article 16 of GDPR), in relation to a request for rectification, should you notice that the data is inaccurate or incomplete.
    • Request the Controller to erase the data (Article 17 of GDPR).
    • Request that the Controller restrict processing (Article 18 of GDPR); for example, if you notice that your data is incorrect, you may request that the processing of your data be restricted for a period that allows us to verify the accuracy of that data.
    • Request that the Controller transfers the data to another Controller, provided that this is technically feasible and the conditions set out in Article 20 of GDPR are met.
    • Object to the processing of data (Article 21 of GDPR) on grounds relating to a particular situation, where the data is being processed for purposes based on the Controller’s legitimate interests – Article 6(1)(f) of GDPR.
    • Withdraw their consent to the processing of their personal data at any time, if the processing is based on consent (Article 7(3) of GDPR).
    • Lodge a complaint regarding the processing of their personal data by the Controller with the President of the Office for Personal Data Protection.
  3. Data relating to web traffic analysis, collected via cookies and similar technologies, may be stored until the cookie expires. Some cookies never expire; therefore, the data retention period shall be equivalent to the time necessary for the Controller to fulfil the purposes related to data collection, as well as to ensure security and analyse historical data relating to website traffic.
V. Transfer of personal data outside the EU

The Controller may use tools provided by entities that are established outside the European Economic Area (hereinafter: EEA) or that may store data outside the EEA. Personal data shall not be transferred to international organisations. The Controller shall take all legally available security measures to ensure the secure transfer of this data. Personal data may be transferred outside the EEA under the derogations set forth in Article 49 of GDPR, provided that the conditions specified in the Article apply. VI. Profiling

User’s personal data shall not be processed in an automated manner, including in the form of profiling, i.e. no decisions producing legal effects on a given person or significantly affecting such person in a similar manner shall neither be based solely on the automated processing of personal data nor shall they involve such a decision made in an automated manner, as referred to in Article 22(1) and (4) of GDPR.

VII. Types of Cookies used

Cookies used by the Controller are safe for the User Device. As a general rule, it is not possible for viruses, other unwanted software or malware to enter User Devices via these channels. These files allow identifying the software used by the User and customise the Service for each User individually. Cookies usually contain the name of the domain from which they originate, the duration of storage on the Device, and a value assigned to them.

The Controller uses two types of cookies:

  • Session cookies: stored on the User Device and remaining there until the end of the browser session. The stored information is then permanently deleted from the Device memory. The mechanism of session cookies does not allow collecting any personal data or any confidential information from the User Device. The Controller uses the following on the basis of the retention period;
  • Permanent cookies: stored on the User Device and remaining there until deleted. Finishing a browser session or switching off the Device does not remove them from the User Device. The mechanism of permanent cookies does not allow collecting any personal data or any confidential information from the User Device.

The Service uses the following cookies, categorised by their purpose:

  • “Necessary” – cookies that are essential for the website to function properly by enabling basic functions such as page navigation and secure access to areas of the website. The website cannot function properly without these cookies. They do not require user consent.
  • “Preference” – cookies that allow the website to remember information that changes the way the website looks or works, such as the user’s preferred language or the region they are in.

VIII. Purposes for which Cookies are used

The Controller uses First-Party Cookies for the following purposes:

  • service configuration, adjusting the content of the Service’s websites to the User’s preferences and optimizing the use of the Service’s websites;
  • to identify the Service User’s device and display the website accordingly, tailored to their individual needs;
  • saving settings selected by the User and personalising the User’s interface, e.g. in terms of the selected language or the User’s region;
  • to remember the history of pages visited on the Service for the purpose of recommending content; font size, website layout, etc.;
  • to correct configuration of selected features of the Service, enabling, in particular, the verification of the authenticity of the browser session;

IX. Possibility to determine the conditions of storage or access by Cookies

As described above, in addition to Cookies that provide the Website’s basic functionality, we also use Cookies to collect and process personal data and usage data in order to personalise the content and advertisements displayed on the Website and to analyse traffic on the Website.

We use these Cookies to better tailor the adverts and content we display to the User’s preferences and interests, as well as to research and analyse interest in our own content and websites. However, we only install Cookies of this type with the User’s explicit consent, given during their first visit to our Website using that device.

XI. Further information regarding social media platforms

Our website contains only links to our profiles on social media platforms such as Facebook, LinkedIn, Instagram and TikTok.

Clicking on the link will redirect you to an external social media site. It is only once the User has accessed the service in question that the website operator shall process the User’s personal data, in accordance with its privacy policy.

Until the User clicks on the link and leaves our website, no data is exchanged between their Device and social media platforms, nor is any information (e.g. The User’s IP address) automatically transmitted to those services.

XI. Final provisions
  1. The Controller reserves the right to update the content of the Privacy Policy.
  2. The Controller reserves the right to remove or amend the content presented on the website without prior notice. The Controller shall not be held liable if, for any reason beyond the Controller’s control, the Website is unavailable at any time or for any period.
  3. The Controller reserves the right to occasionally restrict access to certain parts of the Website in connection with maintenance work or updates to the Website.
  4. This Privacy Policy comes into effect on the date it is published on the Website.
  5. In matters not covered by the Privacy Policy but relating to its subject matter, and in the event that any part of the Privacy Policy is inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the disputed provision of the Privacy Policy, in particular:
    • the Act of 23 April 1964 – the Civil Code;
    • the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product;
